Terms and Conditions of Agreement

GENLINE - the Swedish Church Records archive (Private use)

1. General

1.1  These terms and conditions represent the agreement between Genline AB, 556631-1386 ("Genline") and the customer ("Customer") regarding the Customer's use of the "Genline - the Swedish Church Records archive" service ("Service"), whereby Genline for private use offers the Costumer an opportunity of searching ancestors through Swedish Church Records on the Internet.

1.2  Please take the time to read these terms and conditions carefully and understand their full contents before using the site http://www.genline.com (the "Site"). The Customer's use of the Site confirms the Customer's acceptance of all of the terms and conditions set forth below. The Customer also agrees to periodically review these terms and conditions and to be bound by all modifications hereto. These terms and conditions were last revised on August 12, 2002.

1.3  Genline supplies general information about the Service on the Site. Any messages from Genline to the Customer will be given by electronic and/or conventional mail in the manner described in paragraph 14. The Customer is expected to possess basic knowledge of the Internet and of the technical skills required to handle the member account.

2. Granted Rights

2.1  Subject to these terms and conditions, Genline grants the Customer a personal, non-exclusive, non-transferable right to use the Service as long as this agreement is valid.



2.2  All associated rights, including trademark, copyright and all other intellectual property rights, are the property of Genline or of a third party with whom Genline has entered into an agreement. The Customer is not granted any right to use the Service or any the intellectual property, except as permitted by these terms and conditions.
3. Validity and Termination of the Agreement

3.1  The agreement has been entered into, and the subscription shall become effective, when the Customer has made his registration for the ordered Service . Genline reserves the right to, after having carried out a credit assessment, decline to enter into an agreement if the Customer is deemed to have acted in breach of these terms and conditions or has failed to comply with any terms and conditions in previous arrangements with Genline.

3.2  The agreement is valid until further notice for a binding period ("term of agreement"), which may vary depending on the type of subscription selected by the Customer.

4. Payment and Charges for Subscription

4.1  Charges for the Service can be found on line in the price list applicable at the time. The Customer is liable to pay the charges online when the registration for the Service is made. Payment shall be deemed to have been made when Genline has confirmed the payment. Genline will close the Service if the Customer fails to pay the charges for the Service when due.

4.2  If payment has not been made on the applicable due date, penalty interest and the reminder fee applicable at the time will be charged as of the applicable due date.

5. Transfer of the Agreement

5.1  The agreement and the Services associated therewith may not be transferred by the Customer at any time to any third party.

6. Limitation of Liability

6.1  Genline will not be liable for software errors if the software distributed with the Service has not been developed by Genline. Genline will not be liable for defects in the Customer's computer or adjoining equipment resulting from the use or the installment of software associated with the Service.

6.2  Genline will not be liable for operational interruptions or communication obstructing errors due to circumstances relating to the Customer or beyond Genline's control. Genline reserves the right to hold the Customer liable to pay compensation for the debugging of errors on the Site, caused by the Customer's use.

6.3  Genline will not be liable for damages or losses due to circumstances beyond Genline's control or for unforeseen circumstances, e.g. accident, war, riot, weather conditions, labor conflict (regardless of whether this encompasses Genline's personnel or not), disruptions in the network of another operator or action or negligence on the part of any third party.

6.4  THE SITE IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON?INFRINGEMENT OR TITLE, AND GENLINE HEREBY EXPRESSLY DISCLAIMS ANY AND ALL SUCH WARRANTIES. GENLINE MAKES NO REPRESENTATIONS OR WARRANTIES WITH REGARD TO THE QUALITY OR ACCURACY OF ANY CONTENT ON THE SITE. BY ACCESSING THE SITE, THE CUSTOMER ASSUMES ALL RESPONSIBILITY AND RISK OF USE OF THE SITE AND ANY PRODUCTS AND/OR SERVICES DESCRIBED HEREIN OR OBTAINED USING THE SERVICES PROVIDED ON THE SITE.

6.5  UNDER NO CIRCUMSTANCE SHALL GENLINE BE LIABLE TO THE CUSTOMER OR ANY OTHER PARTY FOR ANY PUNITIVE, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER (HOWEVER ARISING, INCLUDING BUT NOT LIMITED TO GENLINE'S NEGLIGENCE), INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM LOSS OF USE, DATA, SALES, GOODWILL OR PROFITS, WHETHER OR NOT GENLINE HAS BEEN ADVISED OF SUCH POSSIBILITY OR UNDER ANY LEGAL OR EQUITABLE THEORY OF LIABILITY, IN TORT, CONTRACT OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SITE. THE CUSTOMER'S EXCLUSIVE REMEDY, AND GENLINE'S ENTIRE LIABILITY, IS LIMITED TO THE AMOUNT THE CUSTOMER PAID TO GENLINE FOR THE SERVICE PROVIDED TO THE CUSTOMER BY GENLINE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT WHICH GAVE RISE TO GENLINE'S LIABILITY. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF ANY WARRANTY OR REMEDY PROVIDED UNDER THESE TERMS AND CONDITIONS FAILS OF ITS ESSENTIAL PURPOSE.

6.6  Complaints or other demands relating to the terms and conditions must be made in writing within one (1) year after the damage has been discovered or reasonably should have been discovered. If the Customer fails to make a timely complaint or demand, the Customer shall lose such right.

7. Customer Obligations and Liability

7.1  The Customer is liable for any other third party who, due to the Customer, has been given access to use the Service. Should it come to the Customer's knowledge that any third party is acting in breach of the terms of the agreement, the Customer shall immediately notify Genline of the breach.

7.2  The Customer is fully responsible for maintaining the confidentiality of his/her/its username, password and subscription account number.

7.3  The Customer is responsible for any installment of software supplied by Genline. Such installment shall be made in accordance with the instructions applicable at the time. Genline shall not be responsible for any problems due to incorrect installment of the supplied software. Genline does not guarantee compatibility between the supplied software and any other software installed in the Customer's computer.

7.4  The Customer may not transfer to any third party the account/subscription or parts thereof of the Service without the written consent of Genline.

7.5  The Customer shall not reproduce except for personal use, alter, distribute or make any derivative work from, any material, whether graphic, visual or copy, on or accessed through the Site, without the prior written consent of its owner(s). Furthermore, the Customer may not remove, alter, or cause to be removed or altered, any copyright, trademark, trade name, service mark, or any other proprietary notice or legend appearing on the Site or on any content posted on the Site.

7.6  The Customer represents to Genline that the Customer: (i) will not use (or cause or permit to be used) the Site or any services available through the Site in any illegal or proscribed manner or in any manner intended to disrupt or damage the Site, its contents or its security measures; (ii) will not use the Site in any manner to harass or disparage Genline or its sponsors, customers or their respective products or services or personnel; and (iii) has read and understands, and will comply with these terms and conditions, as amended from time to time.

8. Termination

8.1  Genline is entitled to close the Service and terminate the agreement immediately if the Customer has used the Service in an inappropriate way. Inappropriate uses include, without limitation:

  • Several simultaneous log-ins under the same subscription.
  • Acts by the Customer which shall inconvenience Genline, Genline's system, and/or other customers of the Site and systems connected therewith.
  • Acts by the Customer attempting to access an account or data resources not authorized to the Customer.
  • Acts by the Customer deliberately attempting to access or accessing to a Service without paying for it.
  • Acts by the Customer deliberately attempting to change or destroy or changing or destroying any data information in the possession of Genline not authorized to the Customer.
  • Acts by the Customer selling an account/subscription or parts of it to a third party without the written consent from Genline.
  • Acts by the Customer using an account/subscription for other than personal purposes without the written consent from Genline.
  • Acts by using any information downloaded from Genline's database for other than personal purposes or transmissions to a third party of any information downloaded from Genline's database without the written consent of Genline.

8.2  Should the agreement be terminated due to the Customer's acting in breach of paragraph 8.1, Genline reserves the right to immediately terminate any other agreement entered into with the Customer.

8.3  A breach of these terms and conditions may cause liability for damages including but not limited to costs related to measures taken by Genline due to the Customer's inappropriate use of the Service.

8.4  Should the agreement be terminated for any reason, the Customer will no longer have the right to use the Service. Charges paid in advance will not be reimbursed.

9. Changes in the Service and of the Charges

9.1  Genline shall be entitled to make immediately effective changes to the Service or the charges due to amended taxes, official levies, laws, exchange rates or any other circumstances beyond the control of Genline, which directly or indirectly effects the Service and/or Genline's cost of the Service. The charge may be reduced without prior notice to the Customer.

9.2  Genline reserves the right to make any change to the Service which does not substantially effect the content of the Service, without prior notice to the Customer. The Customer shall be given notice of substantial changes to the Service or of changes to the charges at least thirty (30) days before the changes come into force. Notice shall be given in the manner described in paragraph 14. The Customer shall then be entitled to terminate the agreement in accordance with paragraph 3 above.

10. Changes to the Terms and Conditions

10.1  These terms and conditions are valid until further notice. Genline has the right at any time to change or modify these terms and conditions. The Customer shall be given notice of such changes at least one month in advance through the members' pages on the Site.

10.2  The Customer shall, through the members' pages on the Site, acquaint himself with the new terms of agreement before they become effective. The failure of the Customer to contact Genline within thirty (30) days from the announcement shall be deemed to constitute acceptance of the new terms and conditions.

10.3  If the changes to the terms and conditions as mentioned above in paragraphs 10.1 - 10.2 are considered detrimental to the Customer, the Customer shall be entitled to terminate the agreement. The termination shall be made in writing in the manner described in paragraph 14 and shall be effective as of the later of (i) the date the new terms and conditions come into force, or (ii) five (5) days after Genline's receipt of such notice.

11. Forums

11.1  Genline may from time to time host on the Site interactive forums with its customers, such as chat rooms, bulletin boards or e?mail service (collectively "Forums"). Information posted on any Forum is supplied by third parties and other users, unless Genline's authorized representative identifies Genline as the content provider. Any opinion, advice, statement, service, offer or other information or content expressed or made available by any third party or other user on any Forum are those of their respective author(s), and not of Genline.

11.2  The Customer agrees that the Customer will not post any of the following material on any Forum: (i) material that threatens or abuses others, or which is defamatory or libelous, or which is invasive or violative of another's privacy; (ii) material that the Customer does not have a right to post, including but not limited to proprietary material of any third party; (iii) material that advocates any illegal activity or discusses an intent to commit an illegal act; (iv) material for advertising or commercial solicitation; (v) material that is vulgar, obscene, pornographic or indecent; or (vi) material that does not pertain directly to the subject matter of the particular Forum.

11.3  Genline reserves the right to monitor Forums hosted on the Site to determine compliance with these terms and conditions and/or any applicable laws, rules or regulations, and reserves the right to remove, refuse to post or redact any posting, at any time after the discovery thereof. Notwithstanding these rights, the Customer remains solely and exclusively responsible for the content of the Customer's postings, including but not limited to e-mail content. The Customer acknowledges and agrees that neither Genline nor any third party site will have any liability with respect to any content the Customer posts on any Forum. By posting a message or other content on a Forum, the Customer grants Genline a royalty?free, perpetual, irrevocable, non?exclusive right and license to use, reproduce, modify, adapt, translate, create derivative works from, distribute, perform and display any such message or content (in whole or in part), and/or to incorporate it in other works in any form, media or technology, whether now known or hereafter developed by Genline or its authorized representatives.

12. Confidentiality and Privacy

12.1  Genline may collect and store personally identifiable information about persons who visit the Site and voluntarily submit information in contacting Genline. Genline may also collect and store aggregate or anonymous information about user contact with and use of the Site. Genline may use the information to contact the Customer about Genline's products and services or those of Genline's sponsors from time to time. The Customer may ask Genline to delete any information about the Customer and cease further contact at any time by sending Genline a request marked "Privacy Request," addressed as follows: info@genline.com or by telefax at 46-8-6003320.

12.2  Genline will not disclose the contents of any private e-mail that the Customer transmits or receives on or through the Site, the Customer's username, password or subscription account number, without the Customer's prior consent unless (i) required or reasonably appropriate to correct a technical defect or problem on the Site; (ii) required by law or legal process; and/or (iii) such disclosure is made by Genline in good faith to comply with law or legal process, protect Genline's property or other rights, or protect the safety of a Genline employee, representative or other personnel, customer, sponsor, user of the Site or any other person.

12.3  Genline respects the privacy of all of its customers. However, Genline cannot guarantee the security of any information the Customer may disclose over the Site or any site linked to the Site and Genline makes no representations or warranties about the security of any information the Customer may provide to or receive from any third party on a Forum on the Site or through a linked site. The Customer is solely responsible for maintaining the confidentiality of the Customer's username, password and subscription account, and any and all activities under the Customer's account.

13. Links

13.1  For your convenience, the Site may contain links to web sites of sponsors and others that Genline believes may be of interest to our customers and prospective customers. Genline is not able to confirm the accuracy of any information or the quality of any merchandise or service offered or contained on any linked site. Genline makes no representations or warranties regarding the reliability, quality, appropriateness or legality of the content on any web site to which the Site may be linked or which may be linked to the Site. These links are not intended as, nor shall they constitute, an endorsement by Genline of any such other web site, its owners or merchandise or service made available at or through such site.

14. Contact Information/Notices

14.1  Any notice that may be given by Genline to a Customer shall, at Genline's descretion, be sent by mail to the address set forth in the Cutomer's subscription application or to the Customer's e-mail address.

14.2  If the Customer has any questions regarding these terms and conditions or the Customer's rights in using the Site, or if Customer needs to provide notice to Genline, the Customer should contact Genline at:
